PRESENTATION:
1.      Certificate of Thanks and Appreciation to Bob Goodwill for Service on the Senior Council Committee.
2.      Certificate of Recognition Presented to Bob Goodwill for Senior Citizens Recognition Program.

CONSENT AGENDA:
1.      Resolution re Surplus of Airport Fuel Tank.
This item is to declare equipment as surplus and allow the City Manager to dispose of as set forth in the Resolution.

2.      Resolution re Surplus of Miscellaneous Utilities Equipment.
This item is to declare equipment as surplus and allow the City Manager to dispose of as set forth in the Resolution.

3.      Approval of Ground Lease Termination Agreement with Boy Scout Troop 544, Inc.
Acceptance of the proposed lease termination agreement with Boy Scouts Troop 544.

4.      Authorization to Commence Eviction Proceedings, City Trailer Park, Lot B-39.
Authorization to proceed with eviction proceedings.

5.      Authorization for Grant of Easement to Progress Energy for Tomoka Woods Water Plant.
Approval of the proposed Grant of Easement and authorize the Mayor, Commissioners and City Clerk to execute it as required by Progress Energy.

6.      Change Order No. 1, Alabama Avenue Greenway.
Approval of the proposed Change Order No. 1 which incorporates the latest FHWA document.   

7.      Consideration re Final Reconciliation Change Order, Westside Potable Water Main Reinforcement and Harvard Water Main Extension.
Approval of the Final Reconciliation Change Order in the amount of $5,452.80.

BOARD APPOINTMENTS:
1.      Appointment to Citizens Advisory Task Force.
Request for the City Commission to make an appointment to the CATF.

2.      Announcement of Board Vacancies.

OLD BUSINESS:
1.      Second Reading of Ordinance 2010-10, Amending Chapter 15 of the Code, “Garbage,” by Amending Section 15-11, “Solid Waste and Recyclable Materials Collection Service Charges for Commercial Accounts.”
This is second reading of an ordinance amending Chapter 15 of the Code, “Garbage,” by amending Section 15-11, “Solid Waste and Recyclable Materials Collection Service Charges for Commercial Accounts,” by establishing rates for commercial establishments using compactor/roll off units and special “on demand” pickups in excess of the normal contracted service for commercial accounts, as provided for in the contract with Emerald Waste Services.

2.      Resolution Providing for Reimbursement of Spay and Neuter Costs to Cat Caregivers. [Tabled from 3-1-10].
Consideration of the Resolution that will reimburse cat caregivers for spaying/neutering feral cats.

NEW BUSINESS:
1.      Resolution Calling for General and Run-off Elections.
Resolution calling for the General Election on August 24, 2010 and Run-off Election on November 2, 2010 (if necessary).

2.      Resolution Authorizing Special Exception for a Church in the R-1B Zoning District, Located at 321 West Pennsylvania Avenue (Rosewood Center, Inc.).
The Rosewood Center is seeking to locate a church through a Special Exception in an existing residential structure located at 321 W. Pennsylvania Avenue.

3.      Resolution Authorizing Special Exception for a Church in the C-2A Zoning District, Located at 300 North Woodland Boulevard.
The applicant, First Church of Christ Scientist, DeLand, is requesting a special exception for a church be approved at 308 N. Woodland Boulevard.

4.      Consideration re Letters of Support for City Projects in the MPO’s Transportation Priority Project List.
The Volusia County MPO annually calls for each local government to submit letters of support for various transportation projects that are funded through the MPO.  The City’s projects are:
Blue Lake Bike Path – Taylor Rd to Orange Camp
Alabama Ave Trail North Extension Study – Wisconsin Ave to Sperling Sports Complex
Rich Ave Bicycle Trail signage – from Spring Garden Ave to Hill Ave.

5.      Consideration re Memorandum of Understanding between West Volusia Water Suppliers.
Approval of the proposed Memorandum of Understanding.     

6.      Consideration re Additional Interlocal Agreement to Share Study Costs between West Volusia Water Suppliers.
Approval of the Agreement No. 2 between the cities of DeLand, Deltona, Orange City and the County of Volusia for further refinement and peer review of the West Volusia transient ground water model, implementation of an environmental monitoring plan, and additional consulting work in support of the above activities.

The DeLand City Commission holds its regular meetings on the first and third Mondays of each month at 7:00 p.m. in the DeLand City Commission Chambers, 120 South Florida Avenue, DeLand.  Notice of special meetings, workshops, changes in dates, times or locations are provided by separate Public Notices, which are posted at City Hall and on the City’s web site.

The City of DeLand may take action on any matter during this meeting, including items that are not set forth within this agenda.

 ublic participation is encouraged on any matter on the agenda.  If you desire to be recognized by the Mayor, please fill out a Speaker’s Card and present it to the City Clerk.

If any person decides to appeal a decision made by the City Commission with respect to any matter considered at a public meeting or hearing, he/she will need a record of the proceedings including all testimony and evidence upon which the appeal is to be based.  To that end, such person will want to ensure that a verbatim record of the proceedings is made by a court reporter, at the person’s own expense.
